Terms of Service

The agreement covering your use of Hermes — accounts, billing, content ownership, and limits.

§ I

Acceptance.

By creating an account or deploying an agent, you agree to these terms. If you do not agree, do not use the service.

§ II

Accounts.

You are responsible for the credentials used to access your account and for any activity that occurs under it. Notify us immediately if you suspect unauthorized access. Accounts are for a single human or organization; do not share credentials.

§ III

Acceptable use.

Do not use Hermes to send unlawful content, harass others, evade rate limits or anti-abuse measures, mine cryptocurrency on the provisioned VMs, or operate services that violate the policies of the model providers, gateway platforms, or hosting providers we depend on. We may suspend or terminate accounts that violate these conditions.

§ IV

Your content.

Conversations, skills, memory, and configuration generated by your agent belong to you. We do not claim ownership of agent output. You grant us a limited operational license to host, transmit, and back up that content as necessary to run the service.

§ V

Billing.

Each deployed agent is billed as a separate monthly subscription. Charges are processed by Stripe. Subscriptions auto-renew until cancelled. Cancelling schedules teardown at the end of the current billing period; we do not pro-rate or refund partial months. A failed payment moves the agent into a grace period; persistent failure results in suspension and eventual teardown.

§ VI

Service availability.

We aim for high availability but do not guarantee uninterrupted service. Maintenance, provider outages (Hetzner, Cloudflare, model providers), and security incidents may cause downtime. We will communicate planned maintenance where practical.

§ VII

Disclaimers.

The service is provided "as is." We do not warrant that agent output is accurate, lawful, or fit for any particular purpose. AI models can hallucinate, misinterpret instructions, or produce harmful output — review what your agent does before relying on it for consequential actions.

§ VIII

Limitation of liability.

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

§ IX

Changes.

We may update these terms from time to time. Material changes will be communicated via email or a prominent notice in the dashboard. Continued use after a change constitutes acceptance.
